Communities for a Better Environment and two other parties* have brought suit against Contra Costa County. CBE charges that the county improperly approved the EIR for a Phillips 66 project because it failed to disclose that it will rely on tar sands crude transported by rail, a highly significant condition that may have affected the project's approval.
On Wednesday, each party will present its case to Judge Barry Goode. Members of the public are welcome to attend. Although there is no opportunity to offer public comment, this is perhaps the one time in the judicial process that each party will present its case in a succinct way (30-45 minutes each).

*The other two parties challenging the Phillips 66 project are the Rodeo Citizens Association and Safe Fuel and Energy Resources, California.
