Money Isn't Speech! Join us at the rally and California State Supreme Court hearing to put Prop 49, the Overturn Citizens United Act, on the 2016 California ballot.
The act passed the CA Senate and the Assembly and Governor Brown signed it, which meant we should have voted on it last November. But the right-wing Howard Jarvis group sued. When Prop 49 was tabled by the Supreme Court it did so without a hearing, despite the caution by California Chief Justice Tani Cantil-Sakauya that this disenfranchised every California voter.
Read the language of Proposition 49 and you'll see why it's crucial it appear on the ballot:
"Shall the Congress of the United States propose, and the California legislature ratify, an amendment or amendments to the United States Constitution to overturn Citizens United . . . and other applicable judicial precedents, to allow the full regulation or limitation of campaign contributions and spending, to ensure that all citizens, regardless of wealth, may express their views to one another, and to make clear that the rights protected by the United States Constitution are the rights of natural persons only?"
Opponents claim that the California constitution doesn't allow the legislature to create an advisory ballot measure that lets Californians advise our state legislature or the U.S. Congress. An amicus brief filed by Free Speech for People demonstrates that the California constitution does allow voters to "instruct their representatives" and permits ballot measures like Prop 49, which finally sees its day in court on October 6th.
Let's pack the Supreme Court hearing room so the justices see how many Californians demand our right to instruct Congress to overturn Citizens United and assert that inalienable rights belong to natural persons only.
